مقال: أثر الواقع في تطور العقود المالية

ملخص البحث:

قارب هذا البحث أثر الواقع في تطور العقود المالية نظريا وعمليا؛ أما الشق النظري فتناول التنزيل الفقهي وعلاقته بتغير الواقع، والتأصيل الشرعي لتغير الأحكام بتغير الواقع زمانا ومكانا وأحوالا، وبذلك تم إبراز مركزية الواقع في التنزيل الفقهي من خلال ما يقتضيه تحقيق المناط وتنقيحه من النظر في الأسباب والشروط والموانع والرخص والعزائم والصحة والفساد وهو ما يعبر عنه بخطاب الوضع، ثم بيان المقتضيات الشرعية التي تترتب عن تغير الواقع، مع عرض أهم الأصول والقواعد الشرعية الحاكمة لتغير الواقع وتغير الأحكام تبعا لذلك؛

وأما الشق العملي فقد عرض نماذج عملية لآثر الواقع المتجدد في تطور العقود المالية، من خلال مناقشة مجموعة من القضايا الراهنة، وهي: قضية العقود المالية من الرضائية إلى الشكلية، ومن البساطة إلى التركيب، ومن المساومة إلى الإذعان، ومن الفورية إلى عقود الزمن، ثم قضية العقود المالية القديمة والمستحدثة في المعاملات المالية.

Summary of the research:

This research examined the impact of reality on the development of financial contracts in theory and practice.

As for the theoretical part, it dealt with the jurisprudential download and its relationship with the change of reality, and the legal basis for the change of rulings due to the change of reality in time, place and conditions, thus highlighting the centrality of reality in the jurisprudential download through what is required to achieve and refine the logic of the causes, conditions, contraindications, licenses, aids, health and corruption, which is expressed in the speech of the situation, then showing the legal requirements that result from the change of reality, while presenting the most important legal principles and rules governing the change of reality and changing rulings accordingly; this is what is expressed in the discourse of the situation.

As for the practical part, he presented practical examples of the impact of the renewed reality on the development of financial contracts, by discussing a set of current issues, namely: The issue of financial contracts from consent to formality, from simplicity to complexity, from bargaining to acquiescence, from immediacy to time contracts, and then the issue of old and new financial contracts in financial transactions.
